Terms & Conditions

1. Definitions

For the purposes of these Terms, the following definitions apply:

• "Ticket": the access title, free or paid, nominative or not depending on the issuance method, granting the right to request access to the Event under the conditions set out in section 4.
• "Participant": anyone entering the Event area, regardless of actual possession of the Ticket.
• "Venue": the La Madia area and its appurtenances (parking, external areas, access routes) identified and delimited by the Organiser for the Event.

2. Capacity and safety

The Event is held in compliance with the maximum authorised capacity under current safety, venue suitability and public entertainment regulations (including any requirements of the Municipal Supervisory Commission and the Fire Prevention/venue suitability certificate). This limit is set by official certifications and is non-negotiable: it is enforced by the Organiser and security personnel at all times during the event, regardless of the number of Tickets issued, reserved or distributed, even free of charge. The Organiser is not required to publicly disclose the exact value of the maximum authorised capacity.

3. Nature of the ticket and absence of entry guarantee

Possession of a Ticket, free or paid, constitutes a priority title to request access to the Event under the criteria set out in section 4, but in no case constitutes a guarantee of immediate entry, entry by a specific time, or entry at all. Access is permitted only until the maximum authorised capacity is reached. The Organiser reserves the right to limit, suspend, ration or interrupt entries temporarily or permanently at any time, at its own unquestionable discretion, for safety, public order reasons or by order of the competent authorities, without giving rise to any right to compensation, damages or refund, save as provided in section 6.

4. Access criteria and procedures

Access is governed by the following rules:

• priority to Ticket/booking holders, in booking order or according to any assigned time slot;
• once capacity is reached, new Participants may enter only following an exit, on a "one in, one out" basis;
• attendance counting is managed independently by security staff at the entrance using manual and/or electronic tools, whose count is binding in all respects on the Participants;
• in the event of a waiting list, Participants will be admitted in order of arrival, with no guarantee of maximum waiting times or entry before the end of the Event;
• leaving and re-entering is not permitted: once the Event area is left, the Ticket is deemed used and re-entry is not allowed, except with the express written authorisation of security staff;
• the Organiser may require presentation of a valid identity document to verify age and/or match the name on the Ticket, where applicable.

5. Paid tickets — Prices, payment and free tickets

Prices for paid Tickets are shown on the sales platform at the time of purchase and include VAT and any booking fees where applicable. Payment is made via the methods indicated at checkout, and the sales/payment platform (where managed by third parties) operates under its own terms, which the purchaser acknowledges. Purchase or reservation confirmation is sent to the email address provided, which must be correct and active: the Organiser is not liable for non-receipt due to errors in the data provided by the purchaser. Free Tickets are issued in limited numbers and remain subject to all access conditions set out in sections 2, 3 and 4.

6. Refund policy

No refund of the Ticket price is provided for reasons related to the Participant's personal circumstances or circumstances not attributable to the Organiser, such as: denied entry due to capacity being reached, voluntary decision not to attend, late arrival in relation to the Event time, removal for breach of these Terms, or adverse weather conditions that do not nevertheless prevent the Event from taking place. In the event of total cancellation of the Event due to circumstances attributable to the Organiser, the protections provided by current consumer law shall apply, in the manner communicated through the Event's official channels. By proceeding with the purchase or reservation, the Participant expressly accepts this refund policy, without prejudice to any mandatory rights recognised by law.

7. Limitation of liability

To the fullest extent permitted by applicable law, the Organiser is not liable for denied access to Participants holding a valid Ticket where the maximum authorised capacity has already been reached, as this circumstance is linked to compliance with non-negotiable safety rules; is not liable for damage to property or persons resulting from improper, reckless or contrary behaviour by other Participants or third parties unrelated to the organisation; is not liable for items lost, damaged or stolen within the Venue, except for anything deposited with an official cloakroom/storage service, where provided; participation in the Event, which takes place at altitude and in a mountain/outdoor environment, entails acceptance of the risks connected with terrain conditions, altitude and typical alpine weather variations; each Participant is required to independently assess their physical fitness to participate and to make adequate provision (clothing, hydration, any ongoing therapies), releasing the Organiser from liability for consequences arising from undisclosed pre-existing health conditions. In any event, pursuant to Article 1229 of the Italian Civil Code, none of the above limitations shall apply in the event of wilful misconduct or gross negligence by the Organiser, nor for damage to life or physical integrity of Participants caused by conduct attributable to the Organiser.

8. Force majeure and programme changes

The Organiser reserves the right to change the Event programme (times, artists/DJs, set-up, routes) due to force majeure or subsequent organisational needs, without giving rise to a refund, save as provided in section 6. Force majeure includes, by way of example: extreme or dangerous weather conditions for the safety of Participants, measures by public authorities, states of emergency, strikes, unforeseeable technical failures, subsequent unavailability of the Venue for reasons not attributable to the Organiser, epidemics/pandemics or health restrictions. In such cases the Organiser will promptly communicate any changes, postponement or cancellation of the Event and the consequences for Tickets already issued through the official channels.

9. Safety, public order and participant conduct

The Organiser reserves the right to deny, suspend or interrupt access or presence in the Venue, even before the maximum capacity is reached and even for those already admitted, in situations that may compromise the safety of Participants (e.g. localised overcrowding, risky behaviour, instructions from law enforcement), at the unquestionable discretion of security staff, without any right to refund or compensation. The Organiser also reserves the right to refuse entry, or to remove without refund, persons who: are visibly intoxicated or under the influence of drugs; do not meet any age requirements for the Event or for the consumption of alcohol; possess or use drugs, weapons or dangerous objects, or objects not permitted under the regulations published on the official channels; behave in a harassing, violent, discriminatory or otherwise dangerous manner towards themselves or others. The Organiser and appointed security personnel may carry out checks on bags and personal effects at entry, within the limits provided by law, for collective safety purposes; access to the Venue is conditional on acceptance of such checks.

10. Minors

Access is permitted only to persons aged 18 or over, unless otherwise indicated on the official channels. In any event, the serving of alcoholic beverages to minors is prohibited by law and will not take place.

11. Personal data

Personal data collected during reservation/purchase (name, email, any phone number and, where required for security purposes, identity document) are processed by the Organiser, as Data Controller, in compliance with Regulation (EU) 2016/679 (GDPR) and Legislative Decree 196/2003 as amended by Legislative Decree 101/2018, exclusively for the purposes of managing the reservation, access control and security of the Event, as well as for any communications relating to the Event itself, on the basis of the conditions set out in the full Privacy Policy available on the website. 12. Image rights

By purchasing or reserving the Ticket, free or paid, and simply by accessing the Venue, the Participant gives free and informed consent to photographic, audio and video recording during the Event, including by drones or other aerial recording systems, and to their use, reproduction, publication and distribution by the Organiser and its partners, by any means and on any medium now known or developed in the future, for both commercial/promotional and non-commercial purposes (documentation, aftermovie, archive, press, social channels, website and advertising materials), without time or territorial limits and without any consideration, declaring that they have no claim of any kind. Consent may be withdrawn at any time by writing to info@peak-festival.it: withdrawal applies only to future uses and does not affect the lawfulness of uses already made before withdrawal.

13. Transfer prohibition and nominative tickets

Where the Ticket is nominative, it may not be transferred to third parties without prior notice/authorisation in accordance with the procedures indicated on the sales platform. It is prohibited to resell Tickets at a price higher than the issue price (unauthorised secondary market); the Organiser reserves the right to cancel, without refund, Tickets purchased from unofficial channels or subject to unauthorised resale.

14. Intellectual property

The name "Peak Festival", its logo and other distinctive signs used in connection with the Event are the property of the Organiser or its licensors and may not be used without written authorisation.

15. Severability

If one or more provisions of these Terms are declared null, invalid or ineffective by a competent court, this shall not affect the validity of the remaining provisions, which shall continue to produce full effect. The parties undertake, as far as possible, to replace the invalid clause with one that most faithfully reflects its economic and legal purpose.

16. Changes to these Terms

The Organiser reserves the right to update these Terms at any time, giving notice through the "last updated" date at the bottom of the page. Changes do not apply retroactively to Tickets already purchased/reserved with regard to essential economic conditions, except where more favourable to the Participant or required by law.

17. Acceptance

The reservation or purchase of the Ticket, free or paid, implies full and unconditional acceptance of these Terms and Conditions.

18. Governing law and jurisdiction

These Terms are governed by Italian law. Any dispute shall be subject to the exclusive jurisdiction of the Court of Turin, without prejudice to the consumer's court (place of residence or domicile) where mandatorily applicable under Article 33, paragraph 2, letter u) of the Italian Consumer Code.
